If you do not agree with any part of these Terms, you must not use the Website or the Service.

2.1 Ownership

5. Disclaimer of Warranties and Limitation of Liability

All Services and Content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by Jamaican law:

  • Applizone Shipping disclaims all warranties, express or implied

  • We are not liable for delays, losses, damages, or failures caused by third parties, customs authorities, airlines, shipping lines, or acts of God

  • We are not liable for indirect, incidental, consequential, or punitive damages

Where liability cannot be excluded, it shall be limited to the amount paid by the User for the specific Service giving rise to the claim.

6. Freight Forwarding and Customs Authority

6.1 Authority to Act

By using the Service, you authorize Applizone Shipping to act as your agent for:

  • Receiving shipments

  • Transportation

  • Customs clearance

  • Delivery

This includes making declarations and valuations based on information provided or available.

6.2 Address and Shipment Responsibility

Users are responsible for ensuring correct shipping details. The Company is not responsible for misdirected shipments due to incorrect addressing.

6.3 Prohibited Items

The following items are strictly prohibited, including but not limited to:

  • Hazardous materials

  • Firearms and ammunition

  • Explosives

  • Drugs and illegal substances

  • Perishables

  • Cash and negotiable instruments

  • Live animals

Users are fully liable for consequences arising from prohibited shipments.

7. Customs, Duties, and Inspections

All shipments are subject to inspection by Jamaica Customs Agency (JCA) and other relevant authorities.

The Company is not responsible for:

  • Customs delays

  • Seizure or destruction of goods

  • Incorrect valuations provided by customs authorities

Users agree to indemnify the Company against all related claims or penalties.

8. Fees, Invoicing, and Storage

  • Service rates are subject to change without prior notice

  • Invoices are due upon receipt

  • Storage fees may apply after a grace period

  • Unclaimed or unpaid shipments may be disposed of after 30 days

9. Insurance and Claims

Insurance coverage, where applicable, is limited and subject to declared value and exclusions.

Claims must be filed within the specified timeframe and supported by documentation. Compensation is limited to the lesser of:

  • Declared value

  • Invoice value

  • Insurance coverage limits

10. Indemnification

You agree to defend, indemnify, and hold harmless Applizone Shipping, its directors, employees, and agents from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Service

  • Breach of these Terms

  • Violation of laws or third-party rights

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Jamaica.

Any dispute shall first be resolved through good-faith negotiation. Failing resolution, disputes shall be settled by binding arbitration in Kingston, Jamaica, and the decision shall be final and enforceable.

12. Modifications

Applizone Shipping may modify these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
